Marijuana outlets raided

Larry Hamilton, who has terminal cancer among a host of ailments, watched from his wheelchair in dismay Thursday as federal agents shut down THC Pharmacy, the South Hill dispensary that provided him with marijuana.

Hamilton, who undergoes chemotherapy, said he suffers without medical marijuana.

“It clears up the pain and it helps with the nausea,” he said. “It’s irritating. We passed a law in this state to make it legal.”

THC Pharmacy, 1108 S. Perry St., was one of several dispensaries raided throughout the day across Spokane on Thursday. A small band of protesters also gathered outside, chanting “DEA go away” and “We’re patients, not criminals.”

“They just walked in the door and said, ‘You’re busted, everybody sit down,’ ” said Cassandra Wright, a THC Pharmacy employee and mother of Charles Wright, who co-owns the shop with John Vivian. “They walked in with their chests all puffed up and in numbers.”

She said authorities seized computers, phones, receipts, patient files, marijuana, books and the laminator.

“They took everything,” said Wright, who works on the computers in the shop. “They took my personal property like I’m some kind of drug dealer.”

Other shops are being targeted as well, said Assistant U.S. Attorney Tom Rice.

“I can’t say how many places,” he said. “Because of its ongoing nature, we can’t comment any further. We don’t expect to release anything more today.”

However, medical marijuana advocates say agents also raided Evergreen Medical, 12004 N. Market St., Club Compassion, 1004 E. Bridgeport Ave., Human Connection, 5315 N. Market St., and Medical Herb Providers, 306 N. Freya St.

The U.S. attorney’s office sent dispensary operators notices earlier this month advising them to shut down or risk federal enforcement action. Many of the approximately 40 medical marijuana dispensaries reportedly complied, but not all.

Today’s action marks the latest development in an ongoing battle over medical marijuana.

Washington voters overwhelmingly approved medicinal use of marijuana in 1998, but the ballot measure left open the question of how doctor-approved users can legally obtain their pot. Advocates say the state law allows for dispensaries under its “caretaker” provision, but a Spokane County Superior Court jury rejected that argument last month in the first drug-trafficking trial of its kind in Washington.

Additionally, federal prosecutors note that while state law allows for medical use of marijuana, federal law still considers all marijuana possession and use illegal.

Spokane police spokeswoman Jennifer DeRuwe said city officers assisted federal agents in a support role involving marijuana dispensaries.

The raids came as marijuana advocates were hosting a training session for dispensary operators on how to deal with law enforcement raids. The training session, being conducted at the downtown Spokane Public Library, was interrupted by the announcement that raids were under way.

Steph Sherer, executive director of Americans for Safe Access, a medical marijuana research and advocacy group, called on dispensary operators at the training to exercise their rights if they are raided by not consenting to searches and declining to speak to authorities without a lawyer present.

“If you are growing medical marijuana, you are committing civil disobedience,” Sherer said to a room of about 40 people. “There are very real consequences.”

“Our opposition is moral opposition,” she said.

After the raids, a group of medical marijuana providers, users and advocates met at a Spokane law firm to discuss their plan of action. A national call to action will take place in cities across the U.S. Monday at noon, including in Spokane in front of the federal courthouse on Riverside Avenue.

“This is an opportunity to show that this did not shake you,” Sherer said.

She also implored advocates to organize and to meet with local, state and federal elected officials. Kris Hermes, spokesman with Americans for Safe Access, which tracks dispensary raids, said the federal government is “using the leverage of their enforcement tactics to intimidate elected officials to vote a certain way on impending medical marijuana bills,” such as the one Gregoire is expected to veto. There have been hundreds of raids in at least six states that allow medical marijuana, he said.

Medical Marijuana Gaining Steam in Illinois


Back in November, Senate Bill 1381, which would have legalized medical marijuana, failed to receive enough votes.

The man behind the bill, state Rep. Lou Lang (D-Skokie), told  Patch that in the past many lawmakers were for the legislation–enough to pass it and then some–but that they wouldn’t vote for it because of possible political fallout.

Back then, Lang fell short by seven votes during lame-duck season for the state’s General Assembly.

Fast forward to today and a similar bill is gaining steam, as Lang and new allies–some Republicans–are laying out a stricter set of rules to make sure Illinois doesn’t become another California.

The controversial plant would treat people with HIV, cancer, severe glaucoma and other ailments. In California, a person could receive a prescription by simply saying they have frequent headaches.

Marijuana distribution sites in Illinois would also be not-for-profit, unlike those in California. There would also be severe penalties for those that sell the plant after obtaining it through prescription.

“How do you turn down the people who are sick? Who are in pain? People who haven’t been able to have a quality life,” Lang asked elected officials in Illinois. “This is not a bill about drugs. This is a bill about health care.”

While 15 states already allow the use of medical marijuana, Lang said this new bill would be the strictest in the nation.

“It requires them [patients] to get a license from the Illinois Department of Public Health, which would monitor and license each person, and it provides strict penalties for those who break the law or use the marijuana and drive, or try to sell it or distribute it,” Lang told WBBM radio.

If passed, the measure would undergo a three-year evaluation period, during which time lawmakers could review the medical marijuana bill. If objections were to occur, it would be removed and made once again illegal.

But before any of that happens, the bill has to pass the House, then Senate and be signed by Gov. Pat Quinn to be legal. In the past, Quinn said he would sign the such legislation if it reaches his desk.

TEMECULA: Medical marijuana co-op didn’t violate order, judge says

A judge has determined that operators of a medical marijuana cooperative in Temecula did not violate a court order when an undercover Riverside County sheriff’s deputy bought marijuana at the establishment.

Cooperative Patients’ Services, which operated out of rented space in the southern end of Old Town Front Street, had been suspected of violating a temporary restraining order issued in early March that prohibited the operation from distributing marijuana in the city.

The judge determined on Tuesday that the court order had not been violated because it was not in effect when the deputy bought $50 worth of marijuana at the establishment in early April.

“What the court said was the temporary restraining order expired on March 30,” said Peter Pierce, who represents the city in the case.

City officials say Cooperative Patients violates Temecula’s ban on medical marijuana dispensaries.

The establishment is under a court order that barred operators from making marijuana available anywhere in the city, operating without a valid certificate of occupancy or tax permit and “maintaining public nuisances” on its property.

Lawyers for the Cooperative Patients appealed that ruling, which delayed enforcement so an appeal could be filed with the California Fourth District Court of Appeal.

Pierce could not say when the Court of Appeal would act on the request.

Also, the Fontana Patients Collective Association, which had been located on Jefferson Avenue, has closed.

Temecula City Attorney Peter Thorson said attorneys for the collective asked that a temporary injunction barring the establishment from operating in the city become permanent.

“We understand that it’s closed,” Thorson said.

Of those charged with marijuana violations, approximately 88 percent,758,593 Americans were charged with possession only. The remaining99,815 individuals were charged with “sale/manufacture,” a category that includes all cultivation offenses, even those where the marijuana was being grown for personal or medical use. Of all the negative consequences of marijuana prohibition, none is as tragic as the denial of medicinal cannabis to the tens of thousands of patients who could benefit from its therapeutic use.

Modern research suggests that cannabis is a valuable aid in the treatment of a wide range of clinical applications.[4] These include pain relief — particularly of neuropathic pain (pain from nerve damage) — nausea, spasticity, glaucoma, and movement disorders.[5] Marijuana is also a powerful appetite stimulant, specifically for patients suffering from HIV, the AIDS wasting syndrome, or dementia.[6] Emerging research suggests that marijuana’s medicinal properties may protect the body against some types of malignant tumors[7] and are neuroprotective.

Currently, more than 60 U.S. and international health organizations support granting patients immediate legal access to medicinal marijuana under a physician’s supervision.

Driven by the Drug War, the U.S. prison population is six to ten times as high as most Western European nations. The United States is a close second only to Russia in its rate of incarceration per 100,000 people. In 2005, more than 786,000 people were arrested in this country for marijuana-related offenses alone.

Marijuana prohibition causes more problems than it solves, and ruins thousands more lives than it supposedly tries to save. Hemp PlantsHemp is a distinct variety of the plant species cannabis sativa L. that contains minimal (less than 1%) amounts of tetrahydrocannabinol (THC), the primary psychoactive ingredient in marijuana. It is a tall, slender, fibrous plant similar to flax or kenaf. Hearing on Temecula medical marijuana co-op postponed

A Wednesday hearing on Temecula’s request for a court order against a self-described medical marijuana co-op was postponed after a judge said she had been involved in legal and policy matters concerning medicinal cannabis.

Superior Court Judge Jacqueline C. Jackson extended a temporary restraining order against Cooperative Patients’ Services that bars the facility from distributing marijuana anywhere in Temecula. Before that, she rescheduled the hearing with another judge.

As a Riverside County deputy district attorney, Jackson, who was appointed to the bench in December, wrote a report on medical marijuana. She also represented the DA’s office in a court case about medical marijuana dispensaries.

Although California voters approved legalizing marijuana for medicinal uses, cities including Temecula have banned dispensaries within their borders.

J. David Nick, an attorney for Cooperative Patients’ Services, asked that Jackson not hear the case. The judge agreed and the hearing is now set for 9:30 a.m. April 7 before Judge Craig G. Reimer in the Riverside County Historic Courthouse.

The hearing will determine whether Temecula officials get a court order against what they describe as an illegal dispensary.

The city attorney’s office filed the request earlier this month seeking to bar the establishment from making marijuana available, operating without a valid certificate of occupancy or tax permit and “maintaining public nuisances” on its property.

The establishment’s landlord also is named in the complaint.

The establishment’s leaders insist it is not a dispensary, but a non-profit, agricultural co-op in which legitimate medical marijuana patients exchange the drug with one another. The say state law gives them the right to operate.

Outside the courtroom, Nick said he wasn’t sure if he’ll challenge the extension.
