Washington Governor Chris Gregoire says she wants all the states that allow medical marijuana to ask the federal government to reclassify the drug.
She scheduled a conference call among those states Thursday. Meanwhile, a state Senate committee heard testimony Wednesday on a last ditch effort to pass an overhaul of Washington’s medical marijuana law.
Medical marijuana advocates have been trying to pass a bill to allow marijuana dispensaries.
Last month, Governor Chris Gregoire vetoed large parts of their bill. She said it would’ve put state workers in the position of violating federal law.
The new bill would instead leave regulation of dispensaries to local cities and counties. But many of the advocates who supported the vetoed marijuana bill don’t support this new one.

Phillip Dawdy: “This bill was written to please law enforcement, the federal government and the governor, and it’s just a hodgepodge of ideas that are not going to work very well without substantial modifications.”
The Governor says she’ll only consider the new medical marijuana bill if both the Republicans and the Democrats in the House and Senate agree on it.
Fourteen states and the District of Columbia allow medical marijuana for certain patients.
Governor Gregoire says she’ll suggest the states join together to petition the federal government to reclassify cannabis as a schedule II drug. That would allow doctors to prescribe it.

The controversial new medical marijuana dispensary in Rancho Bernardo has worried nearby business owners and residents.
A controversial medical marijuana dispensary in Rancho Bernardo is rebutting claims that it’s harming the community, saying it is meeting most regulations and trying to be a “good neighbor.”
“MediBloom is fully cooperating with law enforcement and code compliance officers to address any of their concerns,” said Lance Rogers, an attorney with Lake APC which represents the dispensary and more than 200 others across Southern California.
The response from MediBloom, at 11665 Avena Pl., Suite 106, comes after some locals complained about the operation during Thursday night’s RB Community Council meeting. San Diego police Officer Susan Steffen spoke about MediBloom at the meeting and said it had been found noncompliant during a city inspection on Wednesday.
The dispensary’s head, Erik Rynko, disputed that during a conversation with Patch on Friday.
Rynko said there was a compliance meeting with city inspectors and police, but the dispensary was found to be following all state laws and compliance regulations. Neighborhood Code Compliance Department officials could not immediately be reached for comment. Rogers, however, acknowledged that the neither MediBloom, nor any of the firm’s other dispensary clients, has a business permit.
It is illegal to operate a business without the proper permit. At Thursday’s meeting, Steffen said all 166 of the city’s dispensaries are operating illegally because they do not have permits. A city process is not yet in place to provide such permits based on the new zoning restrictions part of the new dispensary policy. Steffen said MediBloom and the building owner can be fined for this violation. Only one officer is assigned to deal with the dispensary issue, she said.
Roger’s said all of the firm’s clients—most of which are in San Diego—have tried to get business licenses but have been denied. He would not go into detail about what the findings of Wednesday’s inspection at MediBloom were, citing the potential for future litigation.
Dispensary supporters have challenged the legality of San Diego’s restrictions, such as prohibiting operation within 600 feet of parks, because of inconsistencies with state law.
One of the gray areas of medical marijuana law is providing service to minors. Some complained at Thursday’s meetings that they’ve seen what appear to be teenagers coming in and out of MediBloom. Rynko said that all of MediBloom’s clients are at least 18 years old and identification is checked to verify their age. Rogers said it is up to individual dispensaries’ policies as to whether they will work with minors, though state law does not prohibit those under 18 from receiving prescriptions for medical marijuana.
Rynko also said just because someone looks young that does not mean they are under 18.
It’s also not up to the dispensaries to decide whose condition does or does not merit treatment when they have valid prescriptions, Rogers said.
“It’s analogous to going to a pharmacy and the pharmacy saying, ‘I don’t believe you need this medicine,’ ” Rogers said. “We don’t ask pharmacists to do that and we also shouldn’t ask medical marijuana collectives to do that either.”
Safety also has been a major concern since MediBloom opened at the beginning of the month. According to police reports, on April 5, two unknown suspects kicked in the front door after hours and ransacked the dispensary. The marijuana was inaccessible in a safe and the suspects only got away with some food and candy (non-medicinal). Ten days later, two people leaving an exterior restroom at the dispensary when they were approached by two suspects. One suspect took a bag with a 750 ml bottle of Jack Daniels and sunglasses from one victim. The other suspect sprayed both victims with pepper spray, and both suspects fled.
Rynko and Rogers said they were unaware of the second incident. Rynko said the first incident—the burglary—looked to have just been some kids, and they did not get any marijuana. The dispensary has a security guard, he added.
“We’re not like a lot of other [dispensaries]. No smoking on the premises. We don’t sell any paraphernlia or matches here. People get their medicine and leave. We’re a very nice facility as well,” Rynko said.
Mid-Friday afternoon, there appeared to be a handful of patients coming and going from the collective as the movie Little Miss Sunshine played on a TV in the lobby. Nearby business owners have said there are a steady stream of young-looking people coming in and out of MediBloom throughout the day.
Rogers said he understands people’s hesitation to have dispensaries in their communities, but the operations’ patients and directors believe medical marijuana is lawful and mandated by the state. The Compassionate Use Act of 1996 also gives people the right to the treatment they need, he said.
“[The act] was passed 15 years ago and medical marijuana is not going anywhere.
“Medical marijuana collectives want to be good neighbors and address all of the concerns of their neighbors, of the community. I understand the use of medical marijuana is controversial, but people need to get used to it,” Rogers said.
Rynko said most of the clientele is from Rancho Bernardo—though he declined to say how many patients he has—and people are happy to have something so close to home.

Murrieta Police Arrest Two in Pot, Ecstasy Sales Transaction
Two men, 22 and 23 years old, were arrested when detectives said they witnessed a drug transaction taking place.
More than $600 cash, six ounces of high-grade marijuana and 25 ecstasy tablets were recovered by police during a suspected drug transaction in a Murrieta parking lot.
The two men accused of conducting the transaction were taken into custody Thursday night in the Super Target parking lot off Clinton Keith Road at Interstate 215, police said.
Austin Rhodes, 22, of Murrieta, and Benjamin Sotelo, 23, of Moreno Valley were arrested at 7:40 p.m. while detectives with the Murrieta Police Special Enforcement Team were monitoring the parking lot, said Murrieta police Lt. Tony Conrad in a news release.
“Detectives observed what they believed to be a narcotics transaction occurring inside of a vehicle parked in the lot,” said Murrieta police Lt. Tony Conrad in a news release.
A Murrieta police K9 trained to identify drugs was called to the parking lot and alerted officers to two vehicles involved in the transaction, Conrad said.
“Further investigation revealed the two individuals were in fact involved in the sales and use of marijuana inside Rhodes’ parked vehicle.”
Both men presented detectives with medical marijuana cards, Conrad said.
“However, California state medical marijuana laws do not allow for the illegal sales of marijuana, nor do the ordinances of the City of Murrieta, thus, the cards did not apply to this case.”
Rhodes and Sotelo were arrested on suspicion of conspiracy to sell marijuana and transporting marijuana and taken to Southwest Detention Center in Murrieta.

Colorado Senate snuffs out bill that would set pot limits on drivers
A proposal at the state Capitol to set a limit for how stoned is too stoned to drive died Monday night in the Senate.
In a crucial vote, lawmakers rejected a hard cap on the amount of THC — the psychoactive chemical in marijuana — that drivers could have in their systems above which they would be presumed too high to drive. Instead, a divided Senate sided with medical-marijuana advocates, who urged more study of the proposal.
“We are being asked to make policy by anecdote,” Sen. Shawn Mitchell, R-Broomfield, said in arguing for extra research. “. . . Policy should be well-considered.”
With the teeth of the proposal removed, the Senate later voted to kill the bill, a decision that withstood a subsequent procedural challenge 20-15.
Sen. Steve King, a Grand Junction Republican who was one of House Bill 1261’s sponsors, said failing to set a THC limit would have real consequences. He cited instances of fatal accidents in which the at-fault drivers tested positive for THC.
“Lives are at risk here,” he said.
But Mitchell said some of those drivers had THC levels below the proposed limit — 5 nanograms per milliliter of blood. Echoing the concerns of a number of lawmakers, Sen. Morgan Carroll, D-Aurora, said she thinks the research is inconclusive about how much THC definitively causes impairment, meaning a 5-nanogram limit might snare sober drivers while allowing stoned ones to go free.
It will still be illegal to drive while impaired by marijuana in Colorado, Carroll said. The bill would have made it easier for prosecutors to prove a driver’s guilt.
“If you’re going to have a shortcut to presuming somebody is impaired, let’s make sure the science is established,” Carroll said.
Other lawmakers attacked the bill by arguing that any amount of THC in drivers is too much.
King responded that the 5-nanogram limit is supported by a number of studies and was vetted by multiple groups. He also called out the medical-marijuana industry for lobbying against the bill while, he said, not working as hard to discourage stoned driving.
“Why have we never seen them run an ad that says, ‘Friends don’t let friends drive high’?” King asked.
Before running aground in the Senate, the THC limit had a relatively easy time in the House, passing 51-14.

Frank Marzano, a medical marijuana patient and caregiver whose 2007 marijuana cultivation conviction in Loveland was overturned by the Colorado Court of Appeals last August, got his confiscated property returned to him today. Marzano was joined by his attorney, Robert J. Corry Jr., who won the appeal. Frank’s cultivation conviction was thrown out due to an illegal search. Frank retrieved a truckload of growing equipment, including 19 sets of growing lights and ballasts, 3 3 foot filters and fans, CO2 machine, trimming machine, and many bulbs.
Under the Colorado Constitution’s medical marijuana amendment, Marzano’s property was not to be harmed or destroyed. However, the police refused to return any of his medicine to them, many bulbs were missing or broken, and they cut the power cords off of all the electrical equipment that he retrieved.
